The
institution has a governing board of at least five members that is the legal
body with specific authority over the institution. The board is an active
policy-making body for the institution and is ultimately responsible for
ensuring that the financial resources of the institution are adequate to
provide a sound educational program. The board is not controlled by a minority
of board members or by organizations or interests separate from it. Both the
presiding officer of the board and a majority of other voting members of the
board are free of any contractual, employment, or personal or familial
financial interest in the institution.
A
military institution authorized and operated by the federal government to award
degrees has a public board on which both the presiding officer and a majority
of the other members are neither civilian employees of the military nor
active/retired military. The board has broad and significant influence upon the
institution’s programs and operations, plays an active role in policy-making,
and ensures that the financial resources of the institution are used to provide
a sound educational program. The board is not controlled by a minority of board
members or by organizations or interests separate from the board except as
specified by the authorizing legislation. Both the presiding officer of the

Narrative:
The governing board of
Lawson State Community College is the Alabama State Board of Education. (Board Members). The members of the State
Board of Education are qualified electors of the State of Alabama, and are
qualified electors in the district which they represent (Policy
101.05). The Board has nine members.
It is a policy-making body and is ultimately responsible for ensuring
that the financial resources of the institution are adequate to provide a sound
educational program. The Alabama State Board of Education meets monthly, and
maintains minutes of those meetings on the Alabama Community College System

The Alabama State Board
of Education is composed of the governor who serves in an ex officio
capacity and eight elected members, one from each congressional district in (Policy 101.03). Board members hold four-year terms. The governor serves as
president of the Alabama State Board of Education, and the Board annually
elects a vice-president from among its members (Policy 101.04).
According to State Board Policy 101.01, (Policy 101.01) upon recommendation by the chancellor, the State Board is authorized
to make rules and regulations for governing the Colleges; prescribe the courses
of study and the requirements for granting certificates, diplomas, and/or
degrees; appoint the president of each College; direct and supervise the
expenditure of appropriations for each College; prescribe qualifications and
establish a salary schedule and tenure requirements for faculty; accept gifts,
donations, and devises and bequests of money and real and personal property for
the benefit of the Colleges. State Board Policy 301.01 (Policy 301.01) requires each College to operate within available resources and
to maintain adequate operational balances to ensure the financial stability of
the College. In order for the State Board of Education to ensure that the
financial resources of the institution are adequate to provide a sound
educational program, Lawson State Community College, in accordance with State
Board of Education Policy 304.01 is required to submit an annual budget for
approval prior to the start of each fiscal year (Policy 304.01). Alabama State Board of Education Policy
318.01 (Policy
318.01) requires an annual
audit of each College by the Examiners of Public Accounts. The chancellor may
authorize direct audits and reviews of any College. Written reports of all
audits and reviews must be provided to the Alabama State Board of Education.
Neither the presiding officer of the board, nor the majority of other voting
board members, have contractual, employment, or personal or familial financial
interest in Lawson State Community College.
